Standard Reference Data Terms and Conditions
Introduction. The National Institute of Standards and Technology provides Standard Reference Data (SRD) copyrighted by the U.S. Secretary of Commerce on behalf of the United States of America. All rights reserved. None of our SRD may be reproduced, stored in a retrieval system or transmitted, in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, without prior permission.
Authority - Standard Reference Data Act - Public Law 90-396, July 11, 1968, The Standard Reference Data Act. Purpose: To provide for the collection, compilation, critical evaluation, publication and sale of standard reference data. Excerpt: Section 6 ... the Secretary may secure copyright and renewal thereof on behalf of the United States as author or proprietor in all or any part of any standard reference data which he prepares or makes available under this Act and may authorize the reproduction and publication thereof by others. Public Law 114-329, January 6, 2017,S. 3084 American Innovation and Competitiveness Act, Section 108, Standard Reference Data Act Update. Purpose: To modify the definition of Standard Reference Data provided in Public Law 90-396.
Standard Reference Data - SRD is (A) either [1.] quantitative information related to a measurable physical, or chemical, or biological property of a substance or system of substances of known composition and structure; [2.] measurable characteristics of a physical artifact or artifacts; [3.] engineering properties or performance characteristics of a system; or [4.] one or more digital data objects that serve to calibrate or characterize the performance of a detection or measurement system; or to interpolate or extrapolate, or both, data described in 1-3; and (B) that is critically evaluated as to its reliability under section 290b of Title 15 of the United States Code. Digital data objects may include fingerprints, personal identity verification cards, videos, models, and software.
Copyright - Standard Reference Databases are created and evaluated by NIST. Copyright protection on this compilation of data has been secured by the Secretary of the U.S. Department of Commerce on behalf of the United States Government in the United States and in countries that are parties to the Universal Copyright Convention, pursuant to Section 290(e) of Title 15 of the United States Code.
Prepayment - Licensee shall be given access to the Licensed database upon full payment of the appropriate fee and acceptance of this agreement. Licensee understands that payment will be due in advance.
Disclaimer of Warranties - NIST delivers a high-quality copy of the Database and verifies that the data contained therein have been selected on the basis of sound scientific judgment. However, the Database is provided AS-IS with NO WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE OR FREEDOM FROM INFRINGEMENT OR THIRD PARTY INTELLECTUAL PROPERTY RIGHTS. NIST shall not be liable for any damage that may result from errors or omission in the DATABASE.
References to NIST - NIST does not approve, recommend, or endorse any product or proprietary material. No reference shall be made to NIST or to reports or results furnished by NIST in any advertising or sales promotion, which would indicate or imply that NIST approves, recommends, or endorses any product or proprietary material, or which has as its purpose an intent to cause directly or indirectly the advertised product to be used or purchased because of NIST test reports or results.
Restrictions - It is expressly understood and agreed that the Licensee will not make any unauthorized copies, nor permit others to do so, nor distribute the database in any manner other than specified in this Terms and Conditions. If any unauthorized copies are made, they will be treated as an infringement under U.S. and International Copyright Laws and a breach of the Agreement. If such a breach occurs, NIST has the right to terminate the Agreement. NIST reserves the right to make available to the Licensee, at an additional fee, or at no cost, any new editions, revisions, or supplements to the Database that are prepared during the term of this license. All restrictions specified in this agreement will apply to any such new edition, revision, or supplement delivered to Licensee.
Assignment of Rights - Licensee may not assign the license to another organization without the express written approval of NIST.
Termination - Licensee agrees that the master, backup copy and all editions, revisions, and supplements provided or made under this license shall remain the property of NIST and will be returned to NIST if this Agreement is terminated. If any unauthorized copies are made, they will be treated as an infringement under Copyright Laws and a breach of the Agreement. If such a breach occurs, NIST has the right to terminate the Agreement.
Individual License of NIST Standard Reference Data - SRD products available on removeable media or downloaded from NIST and require installation on individual systems. Licensee retains the rights to use the version of SRD purchased permanently. New versions of SRD, when available by, require an additional purchase. Unless otherwise described in a separate Agreement between NIST and the end user (Distributor, Site license, etc.) the Licensee is granted a non-exclusive, non-transferable, non-sublicensable license to use the Database. It is expressly understood and agreed that the Licensee will not make any unauthorized copies, nor permit others to do so, nor distribute the Database in any manner other than specified in this Agreement or other NIST Agreement. The Database is licensed to an Authorized user and may be installed on multiple computers that are only accessible by the Authorized user or to store the Database medium for reinstallation purposes. Individual licenses owned by Licensee may be assigned to individual Authorized Users. Licensee and its Authorized Users may not reproduce or distribute copies of the licensed material to anyone other than the Authorized Users, for any reason or purpose, unless approved by NIST in writing prior to such use. Licensee and its Authorized Users shall not place any of the materials obtained through the Licensed Service on any network, Internet or Intranet, without NISTs explicit written permission.
Site Licenses of NIST Standard Reference Data - SRD products available on removeable media or downloaded from NIST and require installation on individual systems or are accessible from Licensee Intranet applications. Site licenses grant Licensee up to an unlimited number of Authorized Users. Site licenses require a separate Agreement signed by Licensee and NIST and grant additional rights beyond the SRD General Terms and Conditions.
Online Subscription to NIST Standard Reference Databases - SRD products accessed online, Authorized Users authenticate with username and password or Licensee provided IP Addresses. SRD subscriptions provide access to data for one year or more and expire if the subscription is not renewed. Licensee hereby agrees that systematic downloading of material, e.g., use of scripts (spiders, web crawlers, etc.) to access and download bulk data through the Online Subscription, is strictly prohibited and a violation of this Agreement. Licensee and Authorized users may not share username and passwords to other than Authorized users.
Software Developers of NIST Standard Reference Data - SRD products incorporated into Internet, customer facing, systems created by Licensee to provide non-revenue generating services to their customers such as a public facing sales tool. Software Develops require a separate Agreement signed by Licensee and NIST and grant additional rights beyond the SRD General Terms and Conditions.
Distributors of NIST Standard Reference Data - Licensees with Distributor Agreements for specific SRD products may redistribute SRD data in Licensees products for resale. SRD Distributor Agreements must be signed by NIST and Licensee and supersede Rights defined in the General Terms and Services License.
Citation Example - In the absence of other (e.g., journal) defined requirements, these recommendations provide a consistent manner for appropriate attribution to scientific datasets that are made available under NIST's public access policy. The following minimum requirements and format should be used to cite NIST datasets (a URL is used if a PID is not available): Author/editor (Publication Year), Title, Publisher, Persistent Identifier (PID) or URL (Access date)

Contracts and Signed Statements - As an agency of the United States Federal Government, Department of Commerce, the National Institute of Standards and Technology attests solely to the provisions described above. Receipt of orders by NIST does not imply acceptance of any provisions set forth in the order that are contrary to the policy, practice, or regulations of NIST or the U.S. Government. In general, NIST will not sign any affidavits, acknowledgement forms, or other documents that may be required by any domestic or foreign entity for policy governing procurement of goods and services. This terms and conditions supersede any conflicting and/or additional terms and conditions included in any purchase request or other document submitted to NIST.
